General terms and conditions of a support contract intended for a specific purpose
The contract is concluded between the authorized representative of the Cultural Endowment of Estonia and the recipient of support intended for a specific purpose or the authorized/legal representative thereof.
The objective of the contract is to establish the rights and obligations of parties in using the support intended for a specific purpose awarded by the Cultural Endowment.
It is fixed in the contract that the recipient of support intended for a specific purpose has requested support from the Cultural Endowment by submitting an appropriate application to the Cultural Endowment. The recipient of support intended for a specific purpose confirms the correctness of all data specified in the application. The Cultural Endowment has reviewed the application for support intended for a specific purpose and made a decision, the content of which is set out in the contract.
Amount of support intended for a specific purpose and its usage
The Cultural Endowment awards support intended for a specific purpose to the beneficiary of support intended for a specific purpose in the amount specified in the contract, which shall not be refunded to the Cultural Endowment on the condition that the recipient of support intended for a specific purpose fulfils all conditions set out in the contract. Following awards/grants/support is not allocated to persons that have failed to report.
The list of persons that have failed to support is published on the website of the Cultural Endowment of Estonia.
The objective and term of using support intended for a specific purpose are specified in the contract. The term is a period, during which the recipient of support intended for a specific purpose uses the support amount intended for a specific purpose. Support intended for a specific purpose is paid by bank transfer to the bank account of the recipient of support intended for a specific purpose.
The recipient of support intended for a specific purpose shall:
- use the support intended for a specific purpose for the objective specified in the application and contract within the term specified in the contract;
- submit an appropriate financial and substantive report to the Cultural Endowment on using the support intended for a specific purpose within a month after carrying out the project or part thereof, but no later than within a month as of the end of the term for using the support intended for a specific purpose. submit, in case support intended for a specific purpose has been allocated for publishing a data medium (e.g., a book, publication, CD, DVD etc.), one copy to the Cultural Endowment along with the report. A pre-filled report is sent to the e-mail address of the contact person specified in the application along with an automatic reminder: 1) upon the entry into force of the contract, 2) upon the end of term for usage specified in the contract, 3) upon the expiry of the reporting term;
- in case of violating the contract, repay the unused surplus or the part of support intended for a specific purpose not used for the intended purpose on the term set out in the claim submitted by the Cultural Endowment.
The Cultural Endowment shall:
- pay the amount of support intended for a specific purpose to the recipient of support intended for a specific purpose after the entry into force of the contract by the term specified in the contract;
- review the report within 90 as of receipt thereof. In case of violating the conditions for using the support intended for a specific purpose or in case of emergence of shortcomings in the report, the Cultural Endowment shall notify the recipient of support intended for a specific purpose thereof.
The Cultural Endowment has the right to:
- refuse payment of support intended for a specific purpose to the recipient of support intended for a specific purpose, in case the recipient of support intended for a specific purpose has unfulfilled obligations to the Cultural Endowment by the moment the Cultural Endowment is obligated to pay the support intended for a specific purpose;
- demand the refunding of support intended for a specific purpose upon violation of the contract;
- demand the recipient of support intended for a specific purpose to pay contractual penalty of up to 5% of the support amount intended for a specific purpose;
- demand an annual fine for delay of 7% on the time delayed in refunding support intended for a specific purpose. support intended for a specific purpose shall be refunded in compliance with the term set out in the claim sent by the Cultural Endowment; upon failure to refund by that term, the recipient of support intended for a specific purpose will be obligated to pay a fine for delay;
- inspect all accounting documents connected with using the support intended for a specific purpose or send these to be inspected by the auditor.
Expiry of contract
The contract expires upon acceptance of the report submitted by the recipient of support intended for a specific purpose by the Cultural Endowment or upon agreement of the parties, on the condition that the recipient of support intended for a specific purpose refunds the support intended for a specific purpose to the Cultural Endowment.
The Cultural Endowment has the right to cancel the contract extraordinarily and unilaterally, in case the recipient of support intended for a specific purpose fails to fulfil the terms and conditions of the contract:
- fails to use support intended for a specific purpose for the purpose specified in the contract
- fails to use support intended for a specific purpose within the term set out in the contract
- fails to submit an appropriate report within the term set out in the contract
- has submitted false data to the Cultural Endowment
- under other terms and conditions specified in the law
Other terms and conditions
The support contract intended for a specific purpose shall enter into force upon the return of the contract signed by the recipient of support intended for a specific purpose to the Cultural Endowment. The Cultural Endowment shall enter the contract signed by the recipient of support intended for a specific purpose in the register and the effective date is the date of entry into register. In order for the contract to enter into force, the aforementioned date does not have to be entered in the copy left with the recipient of support intended for a specific purpose.
In case the recipient of support intended for a specific purpose has not signed and returned this contract to the Cultural Endowment within 90 days as of the day the Cultural Endowment sent the contract, the recipient of support intended for a specific purpose shall lose the right to support intended for a specific purpose allocated thereto and the Cultural Endowment has the right to redistribute the support.
Amendment of the terms and conditions of the contract is allowed only under agreement of the parties and it shall be worded as an annex to the contract.
Disputes arising from this contract shall be resolved by the parties by way of negotiations. In case of not reaching an agreement, disputes shall be resolved pursuant to legal acts of the Republic of Estonia.
The support contract intended for a specific purpose is prepared in two copies, whereof both parties will receive one copy.
